Terms of service

Sendy is operated by Stanley Masinde in Kenya. These terms form an agreement between you and Stanley Masinde and govern use of Sendy’s website, sending console, and email API. By creating an account or using the service, you agree to these terms. If you act for an organization, you must have authority to bind it.
The email service
Sendy authenticates API requests, queues email jobs, retries eligible failures, and submits messages through Amazon Simple Email Service (Amazon SES). You can manage API keys, connect sending domains, monitor verification, inspect sending status, and view account usage.
Queue acceptance means a request was recorded. SES acceptance means the provider accepted a message for sending; neither guarantees inbox delivery, delivery time, or that a recipient reads the message. DNS propagation, provider limits, filtering, and third-party availability can affect sending.
Accounts and credentials
Provide accurate account information and keep your password and API keys secure. You are responsible for requests made using your credentials. Keep API keys out of public code and browser applications, revoke compromised keys, and notify the operator of suspected unauthorized use.
Domains and sending authority
Only connect domains you own or are authorized to use. You authorize Sendy to create or connect SES identities and an account-specific SES tenant, retrieve verification records, and check verification progress for your sending domains.
You must publish the required DNS records and maintain your sending authority. Deleting a connected domain can remove its SES identity and stop sending from that domain. Domain deletion does not remove DNS records at your provider or erase historical email and usage records.
Acceptable use
You must have a lawful basis to use recipient information and send each message. Provide required notices and obtain consent where necessary. Honor unsubscribe requests and applicable marketing rules. You are responsible for recipient selection, message content, and the rights needed to submit that content.
- Do not send spam, unsolicited bulk email, or messages to purchased or rented recipient lists.
- Do not send phishing messages, malware, fraudulent content, or impersonate another sender.
- Do not use the service for unlawful content, harassment, or infringement of another person’s rights.
- Do not bypass verification, access another account’s resources, or interfere with service security or availability.
Your sending must also comply with the AWS Acceptable Use Policy and the AWS service terms applicable to SES. We may restrict or suspend sending to investigate abuse, protect sender reputation, comply with law, or respond to provider restrictions.
Your data
You retain your rights in the content you submit. You grant us permission to store, process, and transmit that content as necessary to provide and protect the service, including processing by AWS. Our privacy policy explains how account information and customer email data are handled.
You are responsible for providing lawful processing instructions and keeping copies of information you need. Sendy is an email delivery service, not a permanent archive. Contact the operator if your use requires a separate data processing agreement.
Usage and charges
Usage reporting counts each recorded email job once when SES confirms acceptance. Failed requests and retry attempts do not add another accepted-email count. Acceptance can count toward usage even if the message later fails to reach the recipient.
Any paid plan must state its prices, allowances, billing period, payment terms, and cancellation or refund rules before you purchase it. These terms do not establish a price or authorize undisclosed charges. Applicable plan terms form part of your agreement.
Availability and termination
We may change the service or interrupt it for maintenance, security, or provider issues. No uptime commitment applies unless separately agreed in writing. We may suspend or terminate access for a material breach, unlawful use, unpaid amounts under an agreed plan, or risks to the service. Where practical and lawful, we will give notice and an opportunity to resolve the issue.
You can stop using Sendy and revoke your API keys at any time. Contact the operator to request account closure or data deletion. Ending access does not automatically erase records that must be retained or cancel charges already owed under an agreed plan.
Responsibility and disputes
To the extent permitted by applicable law, the service is provided as available without a guarantee of uninterrupted operation or successful delivery. We are not responsible for failures caused by your content, credentials, DNS configuration, recipient systems, or third-party services beyond our reasonable control.
Nothing in these terms excludes liability or rights that cannot lawfully be excluded. These terms are governed by the laws of Kenya. Subject to any mandatory rights or jurisdiction rules that apply to you, disputes fall within the jurisdiction of the courts of Kenya. Changes to these terms
We publish revised terms with an updated date and notify existing customers of material changes through the service or their account email before those changes take effect. If you do not agree to revised terms, stop using the service and request account closure.
